Venezuela's proposed oil reform, which aims to revolutionize the country's oil industry, has sparked both excitement and controversy. The reform, submitted by interim President Delcy Rodriguez, proposes a radical shift in the way oilfields are operated and managed. Under the new plan, foreign and local companies would be granted unprecedented autonomy to operate oilfields independently, commercialize output, and receive cash proceeds, even as minority partners of the state-owned company PDVSA. This move is seen as a significant step towards attracting much-needed investment and expertise to the oil sector, which has been plagued by nationalizations and asset expropriations under former President Hugo Chavez. However, the proposal has raised concerns among independent lawyers who argue that it conflicts with Venezuela's Constitution, which reserves the oil industry's main activities for the state. The reform also requires the scrapping of numerous related laws approved under Chavez and Maduro, adding another layer of complexity to the implementation process. The proposed contract model, which allows companies to independently produce and export oil through contracts with PDVSA, has been criticized by some experts as contrary to the joint venture model on which the hydrocarbons law is based. The reform also includes a controversial provision that would allow the government to lower royalties and related taxes to 15% from 33% for special projects and those requiring massive investments.
